It looks like at least every month another state drops the ban on same-sex marriage.

So marriage licenses for same sex couples have been issued here in Pennsylvania, at least one one county. An official poured over the state constitution and determined that the law passed to ban same-sex marriage was against the Pennsylvania constitution and therefore invalid... most other Registers of Wills are still upholding the ban... and many are trumpeting their "right-wing Christian, Republican" beliefs on the matter as justification.

So yeah, with that and the ACLU case that is coming up, I see Pennsylvania becoming one of the next battlegrounds for equality.

Not totally... there are still the 36 states that don't provide equal rights... but that is gonna be a slow, grassroots movement to change that.

I teared up at the gym when I saw the verdicts come down. After all the shit the day before with the Voting Rights Act and the Davis Filibuster shenanigans, it made me feel great to see both laws get struck down.

I've been quoting that one for years.

I believe the current cases, at least the one against DOMA, are talking about equal protection under the law as provided by the Fifth Amendment. Their states allow their marriages as well as straight marriages... yet Federal law only recognizes the straight ones... that is a violation of their constitutional rights.

The basis of the California case, aside from Loving v Virginia and common sense, is that a right once given cannot be taken away.

I actually wasn't referring to the first amendment since, by their nature, amendments can be changed. I actually meant the second paragraph of the Declaration of Independence, even though I said first of the Constitution. Hey, I can't always be right.
